I work as a pizza delivery driver. I asked my manager about my “employee time log” (this is a record of what time I clocked in and out). The manager got defensive when I asked him about it. He said if I can’t trust him then I can’t work there anymore and he doesn’t want to hear anything about it anymore. He said all his employees are on the clock for every second they work (another gimmick of his!) He said from the very beginning that no one should come into the “office” (very suspicious because that’s where the printer is so I printed my “employee time log” for records when he was not around). He gives 40 hours, but somehow gets paranoid about giving more than that due to overtime (he hates the fact that drivers could make more than him!). Pizza delivery drivers usually get paid less than the legal minimum wage (the pizza companies get away with this, they have the excuse of we’re making “tips”). When he was not around, I checked my “employee time log” and printed it out. Looks like I did more than 40 hours, I had atleast 3 hours more of overtime, but on the time log it appears to have been removed or adjusted. There is a note “removed by” and the manager’s code, and another note “adjusted by” and the manager’s code. Now my overtime hours is 0.00 (zero). Is this legal? If not then why would there an allowance in the system to “adjust” or “remove” someone’s overtime hours? I worked so hard. I wasn’t even milking the clock. It was so busy that’s why I got overtime. I do feel cheated and feel that I worked for free, especially since it is not even minimum wage ($ 7.25 an hour!) yet they have the nerve to cheat me off my hours? Why is this allowed? Shouldn’t there be a buzzer that gives warning when I am close to getting my 40 hours, so that way I should clock out and stop working instead of work for 3 hours of overtime that will eventually get removed by the manager? Seems like he wants to accomodate himself by proving to the “bigger boss” that all employees stayed under 40 hours and everyone is just happy except me.

    The manager is not making excuses.
    The LAW says that people who get tips can be paid less than minimum wage.

    As for changing the time log,
    GET A NOTEBOOK AND A PEN AND KEEP YOUR OWN LOG.
    Compare it to your pay stub.

    If there’s a difference, file a formal complaint with your state department of labor.

    And once again,
    THIS is why our schools need to teach financial literacy and life skills.
